1. Scope

This English version is provided for convenience only. The German version is legally binding.

These General Terms and Conditions apply to all contracts concluded by consumers with us via our online shop at breezys.de. The version valid at the time of the order applies. Our offer is aimed at consumers within the meaning of § 13 BGB (German Civil Code).

3. Conclusion of contract

The presentation of products in the online shop is not a legally binding offer but a non-binding invitation to order.

How ordering works: you choose a product and the options you want (e.g. size, colour, design) and add it to the cart. In the cart you can change quantities or remove items. Via “Checkout” you enter your contact, shipping and payment details and choose a shipping method. Before submitting you see an overview of all details and can correct them in the input fields or with your browser's back function. By clicking the order button (e.g. “Buy now” / “Order with obligation to pay”) you submit a binding offer to purchase.

Immediately afterwards you receive an order confirmation by email. With this email we accept your offer, and the purchase contract is concluded. If you pay via an external payment service (e.g. PayPal), you are redirected to its site; the order is only completed once the payment is confirmed.

4. Contract language and storage of the contract text

The contract language is German. An English version of these Terms is for information only.

We store the contract text. We send you the order details and these Terms with the order confirmation email. If you have a customer account, you can view your orders there at any time. You can also access and print these Terms on this page at any time.

5. Prices and shipping costs

All prices are final prices in euros. Under § 19 UStG (small business scheme), no VAT is charged or shown. If a price is shown in another currency, it is a conversion; the amount shown at checkout is binding.

Shipping costs apply in addition: shipping within Germany costs €2.90 and is free for orders of €29 or more. To EU countries (incl. Austria) it costs €6.99 and is free for orders of €69 or more. To the United Kingdom and Switzerland it costs €8.99, to Iceland, Lebanon and Ukraine €11.99. You'll find an overview on our shipping page; shipping costs are also shown at checkout before you place your order.

For deliveries to countries outside the European Union (Switzerland, United Kingdom, Iceland, Lebanon, Ukraine), import charges (customs, import VAT) and carrier fees may apply. These are not included in the purchase price and are payable by you.

6. Payment

The available payment methods are shown at checkout. The purchase price is due upon conclusion of the contract. Your account is charged or the payment authorised when the order is completed.

7. Production and delivery

We deliver to Germany, Austria, Switzerland, Belgium, Denmark, Finland, France, Greece, Ireland, Croatia, Luxembourg, the Netherlands, Portugal, Romania, Sweden, the United Kingdom, Iceland, Lebanon and Ukraine.

Every Breezy is individually 3D-printed in size, colour and design after you order. Production takes 3 to 5 working days. Delivery then takes 1 to 3 working days within Germany, 3 to 5 working days to Austria and Switzerland, and 7 to 14 working days to all other delivery countries. Total delivery time is therefore 4 to 8 working days (Germany), 6 to 10 working days (Austria, Switzerland) or 10 to 19 working days (other delivery countries). The period begins on the day after the contract is concluded. If it ends on a Saturday, Sunday or public holiday at the place of delivery, it ends on the next working day.

If you order several items, they may arrive in partial deliveries; this does not incur any additional shipping costs.

If an item is expressly marked as a pre-order, the latest ship date stated for the item, in the cart and in the order confirmation replaces the production time under clause 7; the delivery time under clause 7 is added to it.

8. Retention of title

The goods remain our property until paid in full.

9. Right of withdrawal

As a consumer you have a statutory 14-day right of withdrawal. Details are in our withdrawal policy. You can also declare withdrawal online using our “Withdraw from contract” function.

10. Voluntary 30-day return policy

In addition to the statutory right of withdrawal, we voluntarily grant you a 30-day return right from receipt of the goods, provided the goods are returned unopened in their original packaging (unopened box). For returns within Germany we provide a free return label – just email info@breezys.de. We refund the purchase price within 14 days of receiving the return using the original payment method.

If the size doesn't fit, we will send you a different size once free of charge, even if the box has been opened.

This voluntary return right does not restrict your statutory rights. In particular, your right of withdrawal (which within 14 days also applies to opened goods) and your statutory warranty rights remain unaffected.

11. Transport damage

If goods arrive with obvious transport damage, please report it to the carrier immediately if possible and let us know. This helps us assert claims against the carrier. Failing to do so has no consequences for your statutory rights.

12. Warranty

The statutory warranty rights apply. The limitation period is two years from delivery. For questions or complaints contact info@breezys.de.

The product images in the shop are visualisations. Because every item is individually 3D-printed after you order, slight differences in shade, gloss and surface texture compared with the images can occur as part of the manufacturing process. Such slight differences do not constitute a defect, provided the goods are fit for their ordinary use and are of a quality usual for goods of the same kind. Your statutory rights, in particular your right of withdrawal, remain unaffected.

13. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the Product Liability Act and to the extent of any guarantee given. In the event of a slightly negligent breach of an essential contractual obligation – one whose fulfilment makes proper performance of the contract possible in the first place and on which you may regularly rely (cardinal obligation) – our liability is limited to the foreseeable damage typical for the contract. Otherwise liability for slightly negligent breaches of duty is excluded.

14. Gift cards

If we offer gift cards, they can be redeemed in the online shop until the end of the third year after the year of purchase. Any remaining balance is preserved until then. Cash payout is excluded to the extent permitted by law.

15. Dispute resolution

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

16. Final provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. This choice of law applies only insofar as it does not deprive you of the protection granted by mandatory provisions of the law of the country of your habitual residence.

Should any provision of these Terms be invalid, the validity of the remaining provisions is unaffected. The statutory provisions replace the invalid provision.
